為更好的發展經濟，增加農民收入適時進行種植結構調整，甲乙雙方本着互利共贏的原則，通過友好協商，甲方願將高速路以北，洛孟路東側土地 段租乙方做為租植花卉苗木用地，並達成如下協議:

一、該地為 段，合計為 畝，租自20__年 月 日至 年 月 日止。

二、根據土地承包法有關規定，乙方在租賃協議簽字生效之日起一次性付清每畝每年 斤優質小麥的土地租金，(根據當時小麥市場價格摺合現金兑付各農户)以後每年的 月 日為下年度土地租金的付款日期，如20天付款不清，罰滯納金5%，40天內仍不能付清租金的，視為自動終止協議，甲方有權收回乙方所租用土地，並清理地面所有苗木及其它附屬物。

三、乙方在租用土地期間，根據本地區企業佔地付費情況隨行就市，進行土地租金的增加或減少而調整。

四、乙方在取得土地使用權後，不得改變其土地用途，不得轉讓，買賣或用於其它經營活動。

五、在協議執行期滿前6個月內，甲乙雙方需相互告知租與不租(在同等條件下乙方可優先租用)，如乙方不願繼租，則由乙方對所佔土地進行復耕，達到可耕標準後方可退還給甲方。

六、甲方有責任為乙方提供良好的生產經營環境，若與甲方村民發生糾紛，甲方應配合乙方協助解決。本協議不應以法人變更而解除。

七、本協議在履行期間，若發生國家徵地或其它政策性原因導致乙方無法使用土地時，本協議自動終止，由此引發的補償款項，甲方的土地補償款由甲方所得，乙方在該土地上苗木及其它附屬物的補償款由乙方所得。

八、乙方在土地使用期間應搞好乾羣關係，增進團結，乙方在投入正常生產後應給甲方提供一定數量的就業崗位(每畝地一人)所需員工本組村民優先錄用(不含技術工)。

九、本協議受法律保護，甲乙雙方必須嚴格遵守，如有一方違約，所造成的經濟損失，由違約方全部承擔。

十、本協議如有不盡事宜，甲乙雙方可協商解決，並簽定補充協議，補充協議與本協議具有同等法律效力。

十一、本協議一式三份，甲乙雙方各執一份，村委會備案一份。

十二、本協議自簽字之日起生效。

本着誠實信用、平等互利、共同發展的原則，經甲乙雙方協商一致，就雙方合作事宜及主要商務條件等事項，達成如下意向：

一、租賃位置： B1 層( B1032 號鋪位)。

二、租賃面積：建築面積約 234 m2，套內面積約 117 m2(租賃範圍內面積以雙方最終測量結果為準)。

三、進駐品牌： SEVEN-1 。

四、租賃期限： 2 年，(即 20____年 12 月 16 日至 20____年 12 月 15 日)

五、租金：租金按套內面積____元/月/平方米計;管理費按套內面積 50 元/月/平方米計，最終租金按雙方簽訂的正式租賃合同為準。

十、如乙方對此租賃意向發生改變，則乙方須提前以書面方式通知甲方。

14. 裝修程序

承租方應根據事先向出租方提交併已獲得書面批准的圖紙和規格，自費裝修標的物。

Fit-out Procedures

The Tenant shall fit out the Premises pursuant to the map and specifications which have been submitted to the Landlord for approval in advance and written approval has been issued in this regard.

15. 恢復原狀

租期屆滿或提前終止租賃合同時，承租人需自費將標的物恢復到最初交付時的狀態。

Reinstatement

The Tenant will be required to reinstate the Premises to its original handover condition on its own expenses upon expiration or early termination of the Lease.

16. 法律及其他費用

出租方和承租方應分別承擔各自的法律費用。其它費用應按照中華人民共和國政府發佈的當時有效的法律法規的規定，由雙方各分擔一半。

Legal and Other Costs

Each party shall pay for its own legal fees. All other costs shall be shared equally by both parties per applicable laws and government regulations issued by the PRC government from time to time.

17. 保密

對於本要約中的條款，承租方應嚴格保密。在未獲得出租方書面批准前，承租方不得將本要約中的任何內容泄漏給任何第三方，否則，出租方有權撤回本要約。

Confidentiality

This offer shall be treated in strict confidentiality. The Tenant shall not divulge any or part of these terms to any third party without the Landlord’s prior written approval. Otherwise the Landlord reserves the right to withdraw this Offer.

18.要約及接受
